These terms explain how I work, what you can expect, and what I ask in return. They help make sure we’re both on the same page, so projects run smoothly from start to finish. By working with me, you’re agreeing to the following terms.
Agreement
By paying a deposit or confirming a project with me, you acknowledge that you’ve read and agreed to these terms.
These Terms of Service are governed by the laws of Spain and the European Union.
If you ever have a question or concern about how I work, just reach out — I believe in open, honest communication and aim to make every collaboration a great experience.
Long-term contracts & Retainers
I’m happy to offer retainer agreements or longer-term collaborations for ongoing design support.
Terms for these arrangements, including billing cycles, deliverables, and cancellation. These will be agreed upon in writing for each specific contract.
Payments & Invoicing
To start any project, I ask for a 50% deposit upfront. Once that’s paid, your spot is confirmed, and I’ll begin the design work.
The remaining balance is due before final files are delivered (logos, artwork, etc.).
All invoices are payable within 30 days of issue unless we’ve agreed otherwise in writing.
If payment isn’t made within that time, I reserve the right to add interest at 8% per year, calculated daily, in line with EU late payment practices.
If a project goes quiet and I haven’t heard from you for 30 days or more, I may issue the final invoice early to close things out.
Need a payment plan? No problem, we can set one up in writing before starting.
Cancellation & Refunds
If you decide to cancel a project after I’ve started work or shared concepts, the deposit is non-refundable.
However, depending on how far along we are, I may refund a portion at my discretion.If I ever have to cancel due to illness or unforeseen circumstances, I’ll refund part or all of your payment depending on the work completed so far.
If communication breaks down or the project becomes unworkable (for example, due to micromanagement, lack of feedback, or unpaid invoices), I may pause or end the project. In such cases, the work completed up to that point remains my property, and no refunds will be given.
Design Ownership & Usage
All early sketches, drafts, and unused ideas remain my property. You’re welcome to see them as part of the creative process, but they can’t be used, copied, or modified without my written permission.
Once you’ve made final payment, ownership of the approved, final design transfers to you. Until then, all designs remain the property of Adam Fulton Design.If payment isn’t made, I reserve the right to reuse or modify those designs for other projects or portfolio use.
Fonts & Licensing
If I use any licensed fonts in your project, I’ll let you know what they are and where to buy them.
You’ll need to purchase your own license for any fonts you plan to use in your brand materials, website, or other editable content.I can’t share or transfer my personal font licenses, as that would break the license terms, but I’ll always guide you on how to get your own.
Once a logo is finalized, it usually won’t require a separate font license, since the type is converted into non-editable artwork.
Portfolio Use & Promotion
Unless you specifically request otherwise (for example, under an NDA or a “stealth mode” launch), I reserve the right to showcase the final designs and related visuals in my portfolio, on my website, and across social media or design platforms.
This helps me share my work with potential clients, but I’ll never post anything before your official launch if you ask me not to.
Client Responsibilities & Brand Naming
It’s your responsibility to make sure your business or brand name is legally available and not infringing on any existing trademarks.
If you want to register your logo as a trademark, please seek your own legal advice, I can’t handle trademark registration myself.
If your brand name changes mid-project and I’ve already developed design concepts, I may need to recalculate the project cost to cover the additional work.
Liability & Guarantees
I promise that all my design work is original and created specifically for you. I make reasonable checks to ensure my work doesn’t infringe on anyone else’s designs, but I can’t provide legal guarantees regarding trademarks or copyrights.
You agree that Adam Fulton Design won’t be held liable for any losses, damages, or issues arising from the use of my work or services.
All final decisions on how and where designs are used are your responsibility.
Force Majeure
If something major and unforeseen happens, like natural disasters, government restrictions, or events beyond my control, I won’t be held responsible for delays or missed deadlines.
I’ll always keep you informed and resume work as soon as possible.
